The Punjab Security of Vulnerable Establishments Rules, 2015

No. ____________________. In exercise of the powers conferred under section 19 of the Punjab Security of Vulnerable Establishments Ordinance, 2015 (I of 2015), Governor of the Punjab is pleased to make the following rules:---

1. Short title and commencement.– (1) These rules may be cited as the Punjab Security of Vulnerable Establishments Rules, 2015.

(2) they shall come into force at once.

(3) It shall come into force at once.

2. Definitions.– (1) In these rules:---

(a) “Ordinance” means the Punjab Security of Vulnerable Establishments Ordinance, 2015 (I of 2015); and

(b) “rules” means the Punjab Security of Vulnerable Establishments Rules, 2015.

(2) A word or expression, used in these rules but not defined, shall have the same meaning as is assigned to it in the Ordinance.

3. Meeting of the Committee.– (1) The Committee shall meet at least once in a month for transaction of its business and minutes of every meeting shall be duly recorded.

(2) The presence of fifty percent members of the Committee shall constitute the quorum for a meeting.

4. Vulnerable Establishment.– (1) The Committee shall identify and recommend to the District Coordination Officer the establishments for notifying as vulnerable establishments.

(2) While making recommendation, as mentioned in sub-rule (1), the following factors, among others, shall be considered:---

(a)        nature and volume of business being conducted at the establishment;

(b)       geographical location;

(c)        total area;

(d)       number of entry or exit points;

(e)        existing security and safety arrangements;

(f)        proximity to nearest police station;

(g)       past history;

(h)       level and nature of threat;

(i)        existing security arrangements; and

(j)         information from source or security agency.

5. List of vulnerable establishment.–(1) On receipt of the recommendation of the Committee, the District Coordination Officer shall issue the list of vulnerable establishments.

(2) The list so issued shall be updated on annual basis.

(3) The District Coordination Officer may, however, by notification, establishment from the list of vulnerable establishments.

6. Inspection of vulnerable establishment.– (1) The Committee shall  carry out the inspection of vulnerable establishments on quarterly basis and issue advice, in writing, as to the security arrangements required to be taken by the manager.

(2) While giving any advice, as mentioned under sub-rule (1) of this rule, the Committee shall keep into consideration, among others, all those factors mentioned in rule 5.

7. Responsibility for implementation of advice.– The manager shall implement the advice of the Committee within such reasonable time as may be specified by the Committee.

8. Record of the advice.– The officer incharge of the police station shall get the complete record of the advice from time to time issued by the Committee to vulnerable establishments within the jurisdiction of the police station.

9. Inspection for compliance of the advice.– (1) The officer incharge of the police station may, at any time, inspect the security arrangements of a vulnerable establishment to ensure that the same comply with the advice of the Committee.

(2) The report of such inspection shall be submitted to the Chairperson of the Committee as well as to the Head of District Police.

10. Warning and remedial measures.– (1) The Committee may, if satisfied on the basis of information provided by the officer incharge of the police station or any other source that the security arrangements have not been made as per its advice, issued written warning to the manager specifying the nature of violation and seeking remedial measures.

(2) The manager shall, within such time as may be specified in the warning, take the required remedial measures to implement the advice of the Committee.

11. Implementation of direction of the Committee.– The officer incharge of the police station shall be responsible for implementing the direction of the Committee issued under section 11 of the Ordinance and use reasonable force as may be required for the purpose.

12. Authority for compounding of offence.– The District Coordination Officer may, at any stage, compound an offence under sub-section (1) of section 16 of the Ordinance.
