The Transfer of Railways (Amendment) Ordinance, 2002
ORDINANCE CXIII OF 2002
An Ordinance further to amend the Transfer of Railways
Order, 1962
WHEREAS it is expedient further to
amend the Transfer of Railways Order, 1962 (P.O. No. 33 of 1962) for the
purpose hereinafter appearing;
AND WHEREAS the President is satisfied
that circumstances exist which render it necessary to take immediate action;
NOW, THEREFORE, in pursuance of the
Proclamation of Emergency of the Fourteenth day of October 1999 and the
Provisional Constitution Order No. 1 of 1999 read with Provisional Constitution
(Amendment) Order No. 9 of 1999. and in exercise of all powers enabling him in
that behalf the President of the Islamic Republic of Pakistan is pleased to
make and promulgate the following Ordinance:---
1. Short title commencement.-(1) This Ordinance may be called the Transfer of
Railways (Amendment) Ordinance, 2002.
(2) It shall come into force at once.
2. Amendment of Article 3, P. O. No.
33 of 1962. In the transfer of
Railways Order, 1962 (P.O. No. 33 of 1962), in Article 3,---
(1) for clause (2), the following shall
be substituted, namely;---
“(2)
the Railway Board shall consist of the following members, namely:---
(a) the following shall be ex-officio members,---
(i) Secretary, Railways Division who shall be the
Chairman of the Board;
(ii) Secretary Communications Division;
(iii) Secretary, Finance Division;
(iv) Secretary, Planing and Development Division;
(v) General Manager, Railway Operations;
(vi) General Manager Manufacturing and Services;
(vii) Member Finance, Railways Division,
(b) Three members from private Sector to be appointed by
the Federal Government.”;
(2) in clause (3), for the words “Ministry
of Railways” the words “Railways Division” shall be substituted;
(3) in clause (6), for the words “Ministry
of Railways” the words “Railways Division” shall be substituted; and
(4) for clause (7), the following shall
be substituted, namely:---
“(7)
The Director Administration, Railways Division, shall act as Secretary of the
Board and to assist the Board in discharge of its functions there shall be such
other officers and servants as the Board may appoint.”
